Abstract

The problem statements of the research are: How is the formulation of witness protection regulations in crimin al j u stic e s yst em How is the implementation of the policy of legal protection regulations in penal law process And, how is the policy of the legal formulation of witness protection in the future penal law process. Based on the observation, a research was conducted using a descriptive, analytical method. The establishment of Witness and the Victim Protection Regulation is considered to be very important to protect their individual rights. The formulation of witness protection regulation is a phenomenon in the Indonesian criminal law procedure as the sub-system of penal law. The enforcement of this sub-system will always face the law enforcement officers. In the enforcement of witness protection law, it is found that the witnesses often are not under the protection. Even, they could turn to be the victims. That’s why the formulation of the policy of witness protection program requires the harmony between the Penal Code and the Criminal justice system.
